Child Support for the Future
Divorce is hard for any person to face, especially emotionally. The individual must learn how to let go of the partner they married and the relationship they had. It is a matter of accepting that the marriage no longer works and that there is no avenue left, other than divorce.
When a couple divorces, there are many things to be considered, and settled, besides the personal and emotional matters. The couple may need to resolve the division of any properties, including the family home. Since the marriage will be ended, they also need to decide on the custody of the child and the child support, in cases where there is a minor. This is one area that makes the divorce proceedings more sensitive and time consuming.
Usually, in a family, the parents have no need for an agreement on how each parent provides child support. They simply have a way of supporting the daily needs of the child physically, emotionally and financially. One parent may take care of the physical needs of the child, whilst the other may take care of the financial needs of the child and the family. Thus, a parent is not required to give a certain amount to the child. The situation changes when a couple faces divorce. Each parent should be financially capable enough to provide child support. Inability to do so may affect the decision of the court.
In a divorce it is considered that the child should not suffer. The court, therefore, makes sure that the parents would be able to give the child a bright future. Thus, the parents should be able to plan for all the expenses of the child or children. In cases where one of the parents may have little or no income, the court may consider that the parent is not able to bring up the child. This would affect the decision of the court on which parent would have custody of the child.
However, child support is not only expressed financially. Both parents should be able to continue to give the child the necessary time and attention that they need. Child support involves the parents sharing the responsibility for the child/children. This is normally the case, unless one parent is proven to be incapable of bringing up a child, or if they are mentally incapable and harmful to the child.
The judge will consider the situation and circumstances of both the parents and the child, and will then give a decision on the matter of child support. The needs of the child/children, will determine what child support is given by each of the parents. Both the custodial and non-custodial parent should be able to give the child support, as set by the court and agreed upon by both parties.
