Divorce and child support made easy
Divorce brings many changes for the family and, therefore, people consider divorce an extremely difficult process. The divorce process may continue for months and cause distress to all concerned. However, this is not always the case. Divorce can be less complicated if you are able to talk and settle the matters with your spouse. When spouses agree on the division of assets, the issues of custody of the child and child support, the divorce proceedings go quite smoothly and are less stressful on the family. Divorce is also easier if the parents have a mutual contract and follow it accordingly.
When the reason for divorce is settled and both spouses agree to the terms of the divorce, it is known as ‘uncontested divorce’ and this makes it easier and quicker for the divorce to be completed. However, before the divorce can take effect, both parties must settle the important matter of the custody of the child and child support. There can be different ways to settle on the custody of the child. It may be sole or joint custody. This depends on the ability of the parents to rear their biological and/or adopted children. Child support must be resolved so that the child’s future will not be put at risk because of the divorce.
It is mandatory for both parents to be able to support their child financially. The amount of child support depends on the needs of the children, as well as their ages. In cases where one of the parents is unemployed and does not have a decent income, the court may give the child’s custody to the other partner, thus affecting the outcome of the divorce.
The ability to give financial child support is needed from both parents. The amount will be based upon the income of the parents. Aside from the financial aspect, child support also includes the time spent with the child. The parents should be able to give the necessary time and attention to their children. The education and health of the child is always a priority. Therefore, the parents must provide whatever is needed. The amount of child support may change if it is with the agreement of the parents. The court and both parents should have a settlement and agreed amount for the child support. The outcome should always be in favor of the interests of the child.
Lastly, the court determines if the amount of child support is sufficient and they may, or may not, approve the settlement agreed by the parents. However, since divorce is a legal proceeding, and child support is part of the terms agreed upon, any failings by a parent, regarding child support, may be liable under the law. Thus, it is important that the child support, set in court, is adhered to.
